I had a bailiff appointment fixed for last November which was cancelled at the last moment owing to the lockdown being re-introduced. I wrote to the court to ask if this was now being rescheduled as the tenant is currently in 17 months arrears.

On the 25th January I received this back from the court “Thank you for your email, I have checked your case unfortunately your case does not come under the exemption group and therefore we will be unable to act on the warrant, until Government lifts the stay on warrants being enforced.”

Did I misunderstand the new rules? Does the 6 months of arrears only apply to serving the notice and not to actual eviction? That would seem to make no sense.

Secondly the tenant has suddenly announced that he intends to start paying again and is proposing paying £200 a week to clear the arrears. This would take him almost a year to clear the debt. He has told the agent this by phone not in writing.  The first payment is promised this Friday.

I don’t want to cancel the eviction as he has made numerous unfulfilled promises in the past. If he does begin payments can an eviction be put on hold?
