How should 5 adults living at the property be shown on the AST

We have a 2 storey 4 bed house that 5 Adults wish to let. I believe that they are a couple (not married) and 3 singles. They are all professional, employed and have lived together for 3 years. I haven’t yet seen the references but they are expected all to be good. I’m worried about whether having 5 adults listed as tenants will mean I need to comply with proposed new HMO legislation but if I don’t name all 5 am I more at risk if one leaves (They say that if one leaves they will not replace them and will split the rent between those that remain). Advice appreciated.

    You should name all the adults in this case. Whether or not there is a change in the legislation would be irrelevant because HMO licensing and such is based on occupiers not tenants. Even a baby is classed as an occupier for HMO purposes for example.
