Section 21 – HMO Licence

Essentially this means that tenants share facilities like kitchen, bathroom etc, property is 3 storeys or more and there are 5 or more occupiers.

However, it is possible for a local authority to have additional licensing in place meaning some properties with more than 2 occupiers would need a licence in certain areas. It is also possible for a local authority to have selective licensing in specific areas meaning any property regardless of occupiers would need a licence. It is therefore worth checking with the local authority to see if a licence is required in your area.
