Where a landlord takes from a tenant a number of months rent in advance, commonly six months rent, it’s possible that the rent in advance could be considered a deposit. Where the tenancy stipulates an amount to be rent in advance (such as six months rent for example) and where the amount paid was truly rent in advance, the court has held this will not be a deposit. This page is a replacement front page for our MyDeposits assured shorthold tenancy agreement allowing a landlord to safely accept six months rent in advance (or other sum) and not have to protect the rent element.
