Before a claim is made against a tenant or guarantor for money owed (for example for rent or damage to the property) normally using the small claims procedure, a letter of claim must be served first.

From 1 October 2017, landlords (or agents) must comply with the pre-action protocol for debt claims.

Before a claim is made against a tenant or guarantor for money owed (for example for rent or damage to the property) normally using the small claims procedure, a letter of claim must be served first.

This template is suitable for writing to a tenant or guarantor whilst in occupation or after they have vacated and after previous demands for payment have proved unsuccessful and is the last stage before court proceedings are commenced.

The template includes the required Information Sheet and Reply Form. The letter of claim also includes a sample of a financial statement as provided within the protocol.
