Pre action letter – Arrears or damages, tenant or guarantor after vacated

Before a claim is made against a guarantor for money owing by the tenant (for example for rent or damage to the property) normally using the small claims procedure, a letter before action must be served under the Practice Direction for Pre – Action Conduct.

This template is suitable for writing to a guarantor after previous demands for payment have proved unsuccessful and is the last stage before court proceedings are commenced against the guarantor.

This template is suitable for writing to a guarantor after previous demands for payment have proved unsuccessful and is the last stage before court proceedings are commenced against the guarantor.

This template letter also contains a sample claim form N1 which may be attached which shows you are serious about commencing proceedings. (You may still use the on-line claims procedure, the claim form is just for show!)

The template is in Microsoft Word format and can be changed as you see fit although any changes made must comply with the pre action conduct practice direction.
