Hi

We have a tenant on an assured short hold tenancy commenced on 4th July 2015. There have been occasions when the rent hasn’t been paid, but a gentle reminder and she normally pays (often giving an excuse that her bank made a mistake). She did not pay last months rent due 4th October and has ignored our emails and messages to pay. we would like to serve notice and would like some advice to make sure we get it right

    Firstly, my apologies for the delay in replying. I was hosting a meeting last night and travelling all day until 3am.

    As the tenant is not yet 2 months in arrears, we would recommend in the first instance serving a section 21 notice which is at least 2 months.

    Once the tenant becomes 2 months in arrears (which is actually one month plus one day of non-payment), you can also serve a section 8 notice. This notice is just 18 days long after which time you can apply to the court for possession based on the rent arrears.
