When does a visitor become a tenant?

Our tenant has asked if his parents can stay temporarily while they move from overseas back to the UK. Whilst wanting to accommodate the request, I am concerned the visit of a few weeks could turn into many months or more of the small property being shared by extra people who effectively become tenants with associated wear and tear etc. What would you suggest?

    You are right to be concerned but a situation like this would generally by okay. In order for them to become a tenant there must be an intention to create legal relations. This would include for example accepting rent from the visitors or attending to repair requests from them.

    If you decide to agree, you can use our guest template as a starting point which should assist ensuring they don’t become a tenant(s).
