Preventing Controlling and Recovering Rent Arrears (Wales)

3 month rent arrears

Tenant since 2015. No written tenancy agreement. 3 month arrears. Making excuses as to why not paid, now not reading text messages sent. We know the gas and electric board have put in pre-payment meters as unpaid bills, tenant not told us this, neighbour saw them breaking the door to gain entry and challenged them. We want to get a tenancy agreement in place but want the arrears sorting first. We have not yet sent any letters, do our texts count as demand for rent, they have replied to some texts confirming payment would be made but now not opening the messages. Which letter is the best to send in these circumstances and can it be hand delivered or recorded delivery. Many thanks.

    There’s probably no point doing a tenancy if there’s so much arrears. Isn’t it better to serve notice?

    Depending on whether the tenancy is before or from 1 October 2015, you would need to ensure they had an EPC, Gas safety record and how to rent guide. Also the deposit (if one) and any information would need to be sorted if not already.

    We have arrears templates here but you’re probably as well serving a section 8 noticed based upon the rent arrears. This should be backed up with a section 21 after the earlier items have been given to the tenant.
