6 months rent in advance from 1 of 2 tenants

Hi, I am renting a 2 bedroom flat to 2 tenants. Openrent’s referencing service recommended that one of them should pay 6 months rent in advance and have a guarantor as he had 2 CCJ’s in past 6 years. He has agreed. Is it possible to draft a contract for one tenant to pay 6 months in advance, and the other monthly? Will this affect the notice required (other posts seem to suggest it will)? Am I making my life much too complicated? Thanks.

    Please accept our apologies for the delay in replying.

    This wouldn’t be easily possible and you would need to make the whole initial rent payable 6 months in advance and thereafter monthly for both of them as a single tenancy.

    It is imperative that six months in advance is done correctly otherwise it can inadvertently be deemed a deposit with serious consequences. Please see our replacement front page which you just use with our tenancy builder and replace the front page as appropriate.
