I did not include instructions on operation of boiler and cooker with introductory pack, as I did not realise that the previous tenant had removed them. Tenant was unable to fully operate the appliance so called an engineer as I could not be contacted. There was no fault, only an operational problem. Who is liable for the service charge?

    In our view, they should have contacted you first because they clearly thought it was in disrepair. You should have had the opportunity of repairing first.

    You’re not in breach of repairing obligations until you’ve had notice of the defect and then completed the works with “reasonable expedition”.

    Had they contacted you first, you would have likely been able to fix over the telephone or yourself by attending.
