Question

Joint and Several Tenancies (England)

married name on tenancy

20 Jun 2018 | 1 comment

I know that the tenants moving into my property are getting married a month later. The female is given as the lead tenant, being the wage earner so does it matter that she will change her name after taking up the tenancy, or do I have to mention it on the tenancy agreement?

No, this is no problem. Just enter the information as it is now and then once married make a note of the change and when writing anything use the new name. No new tenancy will be needed after the name change as it’s still the same person.

If ever possession is needed (hopefully not), a note can be made on the court papers explaining the name difference but as we say, that’s only needed at that hopefully unlikely stage.
