Legionella Risk Assessment Where There’s A Freeholder

If I own/rent out a freehold flat and pay service and maintenance charges to the freeholder, who is responsible for the risk assessment, myself as landlord or the freeholder?

    Because the water outlets are in your unit, it is normally you who will be liable for the assessment.

    The freeholder will normally only be liable for communal areas.

    It might be that there are communal water tanks for the hot water in which case, the freeholder may also be liable for an assessment too. However, you will still need to check the temperatures and the shower etc. within your unit under your duties.
