After the Court Order — and Eviction (England) | Landlord Wants Tenant to Leave (England)

Notice of Hearing of Application after date bailiff booked to visit.

7 Nov 2017 | 1 comment

Hello could you please advise on the below:
Possession Hearing 10th October
Order for possession granted on or before 24th October
Notice of Appointment (with Bailiff) confirmed for 9th November
On the 7th November we receive “Notice of Hearing of Application” dated 6th November to take place on 15th November.

We have had no notification that the bailiff appointment is canceled/delayed. We are planning still to meet the bailiff on site and if it still goes ahead (can it?) what is the point/implications of the hearing on 15th November?
Many thanks

We assume the application by the tenant relates to postponement on the grounds of exceptional hardship. On that assumption, the hearing cannot take place after the date given for possession (24 October in your case).

We guess it will be too late to cancel the hearing (but you could try speaking with the Court) but you should state this at the hearing. See here for full details.
