Moving in a Tenant (England) | Tenancy Agreements (England)

Removal of Grounds

27 Jul 2018 | 1 comment

Is it possible for a tenant to request specific possession grounds to be removed from the AST if the landlord agrees.

Eg They want the Ground 2 – Landlord lived/mortgage to be removed as they want to ensure a 3 year tenancy (children in local schools etc references completely fine. High net worth individuals)

It is perfectly acceptable where all parties are in agreement to virtually change anything.

However, ground 2 could be a risky one to remove because almost all mortgage companies will require that clause as part of their mortgage terms. If it’s not mortgaged then won’t matter.
