I am in court in 2 weeks time over rent arrears and was wondering if the tenant pays me before the court date do I still take him to court.
Can I still take him to court over irregularity of payments please as of Ground 11.

    Once you’ve paid the fee for the court, there are no refunds! Therefore, if you did get paid, you may as well still continue.

    You are correct about using ground 11 in that case. That’s why you always put grounds 8,10 and 11, just in case they do pay before the hearing.

    You may not get awarded possession outright if they’ve paid but you might get a suspended order to see how they go for the next few months.

    We always say in this type of situation (although it’s rare for the tenant to pay), you may as well attend court because it’s good court experience when your in a position where the outcome doesn’t matter.
