Question

Landlord Wants Tenant to Leave (England)

Tenant does not submit defence by deadline – what options for landlord?

19 Apr 2017 | 1 comment

The original hearing was passed over for a later and longer hearing as the tenant disputed some of the facts. The next hearing is scheduled for 4th July but the tenant has failed to submit any defence before the deadline from the original hearing – what options (if any) does Landlord have to get possession ASAP?

You should give the court a call and see what they say but we see no reason why you couldn’t make an application to ask for possession any time now without the need for the hearing. Check with the court but the form you would use would be form N244 application notice.
