The Assured Tenancies and Agricultural Occupancies (Forms) (England) (Amendment) Regulations 2019 amends the Assured Tenancies and Agricultural Occupancies (Forms) (England) Regulations 2015 and creates a new prescribed form 6A for when section 21 is being used. The new form must be used in England from 1 June 2019 onwards.
We have already produced the new version ready for the 1st and will be integrating it into our wizard before the 1 June date. Until then, the old version needs to be used. If you’re not in any rush to serve notice on someone, you may like to wait until the 1 June so that you can use the new form.
There aren’t too many changes. It looks a bit different and mainly the change adds a new part about restrictions on serving section 21 if a prohibited payment has been taken (and not repaid) under the Tenant Fees Act 2019.
There’s still the usual grammatical errors to contend with (when producing the form, we never know whether to correct the grammar mistake or just publish as is – we go with as is). For example, one line has been changed to (our highlights):
… at the end of fixed terms ASTs created before 1 October 2015. … it may nevertheless be used for all AST.
There are other similar minor errors within the wording but there’s nothing that has major legal effect and so it’s just a case that the form hasn’t been professionally proofread before being published.
Depending on what time we have, we plan to make changes to the integration of this new form and it might be possible to directly link it with the Tenancy Builder. If we can get this done, it will mean you can insert the information directly from a previous tenancy created from the Builder (landlord name, tenant names, tenancy address etc) which will reduce typing time considerably. The form would then be emailed to you within a few seconds like the tenancy agreements are currently. We will see how we get on but even if we don’t have time for this implementation right away, the form will be available for subscribers form the 1st regardless.
