Pre-action protocol before issuing proceedings

Hi guildy, after issuing a guarantor rent arrears letter 1 & 2 I issued a pre-action letter of claim on 03.01.18. In an email from the guarantor on 08.01.18 he asked for copies of the guarantor agreement of which I posted and emailed to him next day. Since then I haven’t heard from him or had a reply on the pre-action letter of claim within 30 days. I have waited for 30 days since sending off the guarantor agreement, can I now start proceedings with MCOL or do I have to go down the ADR route. This money has been owed since October last year and have had plenty of conversations and promises to pay so ADR would be a waste of time.

    Sounds to us like you’ve done everything needed and are now good to go for MCOL.
