What to Do if Tenancy Is to Continue (England)

Selling with tenents in situ…

Hello….I’ve served notice on my tenents and want to sell my house. They’ve said they know of landlords who may be interested in buying the property and would let them stay on as tenents…Obviously this may save me estate agents fees but Im wondering about the legalities involved in selling with them in situ and other potential obstacles hidden in this sort of situation.     If it actually happens, this is no problem. The tenancy is simply passed to the new landlord under the law (to protect the tenant).

    Between your selling solicitor and the buyers solicitor, they will no doubt send the tenant all the appropriate notifications about the new landlord.

    Any protected deposit will need transferring but that should be straightforward and see how you get on before thinking about that.
