Smoke Alarm

1 Sep 2016 | 1 comment

I’ve just realized that there’s only one smoke alarm in my 2 storey house. Tenant not giving access. I just filed the paperwork for accelerated possession. Is this a worrying situation? Not sure whether the tenant realises anything is amiss. She’s been at the property for 2 years but a new ast was signed in oct 2015

Although it’s an offence not to have a smoke alarm since 1 October 2015, it has no effect on a section 21 whatsoever. It is for the local authority to enforce and if they made contact with you, you would be able to explain that you have been refused access. They may even be able to help you gain access to comply with the duty.
