Tenant lodging a friend in living room

I have been told by another tenant that one of the other tenant has been lodging his friend in the living room for the past two weeks. This tenant will be leaving the flat in August. Any advise on how to manage this situation. Can I visit the flat unannounced? Am I able to hold on to his deposit for breech of contract. Many thanks

    You mustn’t visit the flat unannounced and you must give at least 24 hours notice to do an inspection. We have a template here.

    You would be best first writing a letter asking that if there are any lodgers, they should leave the property immediately. If there are two sharing currently, the lodger would make a third and would make the property an HMO so acting now and asking them to be removed will show you haven’t let it to three people.

    You could then follow up with an inspection in a few days – giving time for the lodger to leave.

    You can only retain a deposit to cover losses you’ve incurred as a result of a breach which isn’t likely to be a great amount in this case.
