If the tenancy went periodic on or after 6 April 2007 when the rules took effect, it had to be protected in 2015 when the Deregulation Act provided a grace period.
However, suppose it went periodic before 6 April 2007. In that case, there is no requirement to protect the deposit except if a section 21 notice is to be served. If section 21 is to be served, it must be either protected or repaid in full before the service of the notice.
