Deposits and Tenancy Deposit Schemes (England) | England | Start of a Tenancy (England)

Further deposit in lieu of guarantor

25 May 2022 | 1 comment

Tenant is happy to pay the equivalent of one month’s rent for a deposit.  Her brother who wants to support her but does not want to act as guarantor is offering to pay a further ‘deposit’ or security of up to 3 months rent.  Can I accept this?  Can I register two deposits against the same property?  Or is there a separate agreement between landlord and brother please?

No, that’s not possible. You cannot take more than 5 weeks’ rent as a deposit.
