How to Unprotect

Hi
I returned my tenants deposit last night in cheque form so that on 31st May, I can serve a s21. (tenancy ends 31/5). I have just gone into my deposits to unprotect it and there is no option suitable for me to explain why I am unprotecting.

What do I do – do I leave it protected until 31/5 even though I have returned it in full?

    We doubt you’ll be able to unprotect the deposit until the tenancy has ended and the tenants vacated. It doesn’t really matter though because as you were holding the deposit (we assume) and so it’s just a box ticking exercise at that point.

    On a point of note: there is no need to wait until the end of the fixed term to serve the section 21 – it just can’t expire before the end of the term. Therefore, once you’ve allowed time for the cheque to be cashed, you can just get on with serving the s.21 even if that is before the end of the term.

    We recommend allowing 7 days for the cheque but if you see it cashed before then, you can promptly serve notice.
