After the Court Order — and Eviction (England) | Landlord Wants Tenant to Leave (England)

Is garage included on Bailiff visit?

3 May 2017 | 1 comment

We have a bailiff visit booked in for possession of a flat & the tenant has put all his belongings in the garage (separate block nearby) & fitted a new padlock.
The garage was rented out with the flat & included in the rent but there is no reference to it on the AST but there is a letter on file referring to it prior to the tenancy starting. Will the bailiff also give possession of the garage on his visit.?
When the application for the bailiff was submitted the property was described as a first floor flat without any reference to the garage.

We can think of no reason why the locks shouldn’t be changed on the garage in the presence of the bailiff at the same time as the flat lock. Take your evidence that it’s included with the tenancy with you.

The bailiff won’t get involved with any goods left in the flat or garage at the time of changing the locks and that will need dealing with separately for which see here.
