After the Court Order — and Eviction (England) | Ending a Tenancy (England) | England

Likelihood of recovering costs

We had to serve a section 8 on a tenant for rent arrears and although they did eventually leave the property and settle the arrears the landlord incurred solicitors costs. The AST does refer that a tenant is liable do you think it is enforceable through MCOL?

Doesn’t sound like the landlord did too bad with this one and could have been a lot worse!

In the real world it could be difficult and there will be the expense of the fees. But, if the term is sufficient, then guess should be entitled with it being served due to a breach of tenancy (so an allowable charge under Tenant Fees Act).
