i just received from the council demand for 1800 for rent paid direct to me for a tenant from 2009. their demand is that he was entitled to a lower housing benefit than what they paid.
this came out of the blue as this relates to 9 years ago.
can statute of limitation be used as it was more than 6 years ago

You are absolutely right, they are barred by section 9 Limitation Act 1980 from claiming the money.
In any event, from what you describe, it wouldn’t be repayable by you anyway. Regulation 101 Housing Benefit Regulations 2006 provides that the person whom recovery should be made from is not who received but instead from the person who caused the overpayment.
