Part payment of claim

21 Feb 2018 | 1 comment

Hi guildy, I have a guarantor who I have made a claim for rent arrears against through MCOL. He has offered to pay me back in 6 monthly installments and has made the first payment today as long as I revoke the claim against him. I am happy to do so but also want to be able to claim against him if he defaults. I have gone on the MCOL site but don’t know which option to take as when I read the options it makes it sound like I would have no further claim against him. Please advise

We haven’t been on MCOL for a little while and have no active claims so not sure what options you may have.

Are you able to send a screenshot (without showing any personal data) or summarise the options?

We can’t think of any reason why if you did stop the claim now that would prevent a future claim less any amounts already paid. It may be that it means that claim itself can’t be reinstated i.e. you would loose the fee and would have to pay again if started again.
