s21 and 6 month rule

served on 10/10/17, exp date 02/01/18

Not sure if we can use as served over 6 months ago, or does that mean 6 months after expiry?

    The six month use it or loose it rue only applies to tenancies granted on or after 1 October 2015 in England. If before then, it’s fine to use. If it’s a new style notice for a tenancy after, the 6 months is from service and therefore can no longer be used.
