s8 was served in august 2017, the tenant paid up and so couldn’t use it, now tenant is back in arrears over 2 months, can the original one be sued to start the claim as its almost 4 months old and doesn’t have the recent arrears on it, does a new need serving or can the arrears just be updated on the claim?

Yes, it’s fine to use. A section 8 notice lasts 12 months.
