Signing a tenancy agreement

5 May 2022 | 1 comment

I know a recent case in the appeal court agreed it was possible for staff of a letting agency to sign a notice and prescribed information but if the agency is a LTD company should the tenancy agreement still be signed under the companies act rules by a director?

Although the point about tenancy agreements wasn’t part of the case, in our view, a tenancy agreement can be signed the same way as a notice now.

You were right to be signing tenancies under the Companies Act because cases before the court of appeal effectively decided that, but it’s now been clarified.

You can see our note on the Northwood case here.
