Question

Council Tax (England) | Ending a Tenancy (England)

Tenant Deposit

18 Jul 2018 | 1 comment

Should I give my tenant back his deposit now while waiting for his section 21 date on 6th Sept. Also do I need to send him a move out letter indicating the last date & month of his rental payment before the section 21 date? Many thanks.

Assuming the deposit was protected and prescribed information was given within 30 days and all done properly, you can retain the deposit until they have actually left. If the deposit wasn’t protected properly, please see here.

You could send a letter before expiry of the notice if you like to try get an indication if they are going to leave by that date or not and asking politely to arrange for the keys. We have a template here.
